Five dead in separate accidents over weekend


A Texas Department of Public Safety trooper investigates the scene of a single-vehicle wreck at FM 1097 and Tanyard Road in Willis. The driver, Mikel Horton, was transported to Ben Taub Hospital in Houston but died soon after. His was the second of four fatal county accidents on Sunday.

Five people were killed on Montgomery County roadways over the weekend, with the death toll on Sunday – already the county’s deadliest day in 2008 – climbing from three to four.

With their deaths, seven people have been killed since Wednesday, with 36 killed in 2008, according to Courier records.

In one of the fatalities, a man is facing criminal negligent homicide charges after the passenger in his vehicle was killed Sunday.

The deadly weekend started when Jeffery David Wilbrett, 46, of Spring, was killed when a Saturn passenger car, driven by 70-year-old Peggy Jane O’Neal of Conroe turned left in front of his motorcycle as he was eastbound on FM 1314 near Sorters Road, according to the Texas Department of Public Safety Conroe Communication Office.


He was pronounced dead at Kingwood Medical Center.

Wilbrett’s death is the seventh motorcycle fatality on county roads this year.

O’Neal was transported to Kingwood Medical Center in stable condition with arm and back injuries, according to DPS.

Sunday: Interstate 45 and Wilson Road

Sunday’s first fatality occurred about 5:40 a.m. in Conroe, at Interstate 45 and Wilson Road.

There, Conroe Police officers found one vehicle that had partially ejected its driver, Christafer Tomasson. Tomasson, 25, was pronounced dead at the scene.

Passenger Sandra Tomasson Haga, 30, was transported by helicopter to Memorial Hermann Hospital in Houston, where she was in stable condition Monday.

A third passenger, a male, ran away from the scene of the accident.

The blue 1997 GMC pickup truck was driving fast on Wilson Road, Berry said, when it struck a guardrail, left the roadway, overturned and rolled down an interstate embankment, according to the police reports.

Officers initially received a report that two males and a female in a vehicle with the same description had allegedly attempted to take a flat-screen TV valued at $900 from the Wal-Mart store located at North Loop 336 and Interstate 45.

CPD is currently investigating the two incidents to see if they are related, Berry said.

FM 1097 and Tanyard Road

About noon Sunday, Mikel Horton, 61, lost control of his vehicle on FM 1097 near Tanyard Road in the Willis area and rolled several times.

After being extricated from the vehicle, Horton, of Coldspring, was transported to Ben Taub Hospital in Houston, where he died shortly after, DPS officials said.

Sunday: Legacy Pines

An accident in her own driveway about 5:30 p.m. Sunday resulted in the death of Karen Collins, 49, of Spring.

Collins parked her 1998 Honda Accord in the driveway of her home, located on Legacy Pines.

She got out of the car and attempted to get her pet out of the back seat when the vehicle began to roll down the driveway, she told deputies with the Pct. 3 Constable’s Office when they arrived.

The open door knocked her to the ground. The car’s tires rolled over her legs and abdomen.

The car was not placed in park and the parking brake was not engaged, Pct. 3 Constable Tim Holifield said.

Collins, who suffered severe trauma to her midsection, was transported to Memorial Hermann Hospital in Houston by helicopter and died Sunday evening, Holifield said.

Kerry Wayne Kelley Jr. has been charged with criminal negligent homicide for his role in a single-vehicle accident that resulted in the death of passenger Lloyd Leon Nesbitt of Porter.

Kelley, also of Porter, was driving a four-door 1996 Cadillac with Nesbitt in the passenger seat and Amanda Moore of Splendora, who is pregnant, and David Haynie of Conroe in the back seat.

The car was traveling fast as it was eastbound on FM 1314 in Porter when it lost control near Old Houston Road and rolled several times about 8:30 p.m. Sunday, a DPS official said.

Nesbitt, 56, was pronounced dead on the scene.

Moore, 21, and Haynie, 23, were transported to Memorial Hermann The Woodlands Hospital, where both were in stable condition Monday.

Kelley, 23, was not injured. He was booked into the Montgomery County Jail about 2:20 a.m. Monday under a $10,000 bond and bonded out Monday morning, according to a jail official.

Kelley showed signs of intoxication at the scene, DPS Trooper Michael Martin said. A blood test was taken at the scene but Martin said the results will take up to two months.

Martin said he also suspected the accident was the result of street racing.

“So there are three charges pending and he’s been charged with at least one until results of blood come back and we can submit a case for possible racing and see if all elements are there,” Martin said.

If all three charges bear out, Martin said, Kelley will face criminal negligent homicide, intoxication manslaughter and a first-degree felony for street racing.

" Thank You for the follow up. Now can someone explain to me why the police let the man go that ran from the scene of the accident that involved Chris? Not once, but twice this guy was let go by the police Sunday. Not only did he leave the scene of an accident, but he supposedly was also involved in a domestic dispute later that day. ??? "

The 2 incidents were related, and I've been waiting for the paper to do a follow up story and I guess I should have known better cause it very seldom ever happens that it turns out that way...
The surveillance tapes showed that the male that was riding in the back of the truck (the one that stole the tv) and the female were the only ones that entered the wal-mart leaving Chris aka Baldy asleep in the truck. The male came out of the store and try to put the tv into the back of the truck all the while yelling at Baldy to get out of there. The wal-mart associate(s) grabbed the tv (resulting in it breaking) from the rear of the truck or from the male (still unclear). Chris startled from being asleep and possibly under the influence sped off not knowing anything other than his fiance jumped in the truck and the man yelled out from the rear to go. He did so, and in his haste and haze flipped the truck resulting in his death. His toxicology report came back and showed he did have drugs in his system, and I personally knowing this kid; wished I could omit that part but it's all part of the truth. I still feel that the wrong person paid with their life for this whole scenario, but who am I to judge! The guy that stole the tv also had the police called on him the same day for domestic violence, but I'm sure he's still roaming free on the streets to this day. Some system we have! "
